Welcome to Xvelogo (“Xvelogo”, “we”, “our”, or “us”), an authorized online retailer of the brands and products offered through our U.S. website.

These Terms & Conditions (“Terms”) govern your access to and use of us.xvelogo.com (the “Site”), including the purchase of electric dirt bikes, electric motorcycles, electric scooters, electric bicycles, accessories, replacement parts, and other products offered through the Site.

By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Site or place an order.

1. Eligibility

You must be legally capable of entering into a binding contract and must have reached the age of majority in your applicable jurisdiction to make a purchase through the Site.

By placing an order, you represent that the information you provide is accurate and that you are legally permitted to purchase the product ordered.

Certain high-powered electric vehicles may also be subject to minimum rider-age requirements under state or local law. Purchase eligibility does not necessarily mean that a product may legally be operated by every purchaser or in every location.

2. Products & Authorized Retailer Status

Xvelogo is an authorized online retailer of the brands offered for sale on the Site. Products sold through Xvelogo are sourced through authorized brand, manufacturer, supplier, or distribution channels.

Product availability, specifications, colors, accessories, packaging, and included components may vary by model, production batch, or manufacturer update.

We make reasonable efforts to ensure that product descriptions and images are accurate. Minor differences in color, finish, packaging, or non-material design details may occur.

3. Orders & Order Acceptance

When you submit an order through the Site, you are making an offer to purchase the selected product subject to these Terms.

An automated order confirmation confirms only that we have received your order. It does not constitute final acceptance of the order.

Unless otherwise required by applicable law, acceptance of your order and formation of the sales contract between you and Xvelogo occur when the product is dispatched for delivery.

We reserve the right to reject, hold, or cancel an order before dispatch for legitimate reasons, including:

  • Product unavailability or inventory discrepancies
  • Pricing, description, or technical errors
  • Payment authorization failure
  • Suspected fraud or unauthorized payment activity
  • Incorrect or incomplete shipping information
  • Restrictions affecting our ability to deliver the product
  • Orders that appear to violate these Terms or applicable law

If we cancel an order after payment has been collected, the applicable amount will be refunded using the original payment method, subject to applicable law and payment-provider processing times.

4. Pricing, Payment & Taxes

Unless otherwise indicated, prices displayed on the U.S. Site are shown in U.S. dollars (USD).

Prices, discounts, promotions, and availability may change without prior notice before an order is accepted.

Applicable sales tax, shipping fees, handling fees, or other charges, where applicable, will be shown at checkout or otherwise disclosed before you complete your purchase.

You agree to provide current, complete, and accurate billing and payment information.

Payment may be processed by third-party payment service providers. Your use of a third-party payment method may also be subject to that provider’s applicable terms and privacy practices.

5. Promotions, Discounts & Pricing Errors

Promotional codes, coupons, sale prices, bundle offers, and other discounts may be subject to separate conditions, including eligibility, expiration dates, product exclusions, and limits on combining offers.

Unless expressly stated otherwise, promotional offers may not be combined.

If a product is listed at an obviously incorrect price due to a typographical, technical, system, or supplier error, we may correct the error or cancel the affected order before dispatch. If payment has already been collected for a cancelled order, we will refund the amount paid.

6. Shipping & Delivery

Shipping methods, fulfillment locations, delivery areas, delivery timelines, and shipping charges may vary by product and brand.

Please review our Shipping Policy and the delivery information displayed on the applicable product page before ordering.

Any delivery date shown on the Site is an estimate unless expressly stated otherwise. Estimated delivery time may be affected by carrier delays, weather, holidays, remote-area delivery, address issues, or circumstances beyond our reasonable control.

We will maintain a reasonable basis for any shipping timeframe stated at the time of sale.

If we become unable to ship your order within the timeframe stated at the time of purchase, we may notify you of the delay and, where required by applicable law, provide you with the opportunity to accept a revised shipping timeframe or cancel the affected order for a refund.

If an order cannot be fulfilled, or if applicable law requires cancellation because the required shipping timeframe cannot be met, we will cancel the affected order and issue the applicable refund.

You are responsible for providing a complete and accurate delivery address. Additional costs caused by incorrect or incomplete address information may be the customer’s responsibility to the extent permitted by law.

7. Delivery Inspection & Shipping Damage

Because electric dirt bikes, electric motorcycles, and electric scooters may be shipped in large or heavy cartons, we strongly recommend inspecting the package promptly after delivery.

If a package or product arrives with visible shipping damage, missing components, or significant carton damage, contact Xvelogo Support as soon as reasonably possible and provide photographs or other relevant information so that we can assist with the claim.

Nothing in this section limits any rights you may have under applicable consumer protection law.

8. Returns & Refunds

Returns and refunds for purchases made through Xvelogo are governed by our Return & Refund Policy.

Return periods, return-shipping arrangements, restocking or depreciation deductions where legally permitted, and product-condition requirements may vary by brand or product.

Where a brand-specific return condition applies, the applicable requirements will be described in our Return & Refund Policy or otherwise made available to you before or in connection with the purchase.

Nothing in our Return & Refund Policy is intended to waive any non-waivable rights available to consumers under applicable law.

9. Manufacturer Warranty & After-Sales Support

Products sold through Xvelogo may be covered by the applicable manufacturer’s limited warranty.

Warranty duration, covered components, exclusions, claim procedures, and remedies vary by brand and product. Please review our Warranty Policy and any brand-specific warranty terms applicable to the product before purchase.

Where manufacturer warranty coverage applies, Xvelogo will provide reasonable after-sales assistance and help coordinate eligible warranty claims in accordance with the applicable warranty terms.

Warranty coverage generally does not extend to damage caused by matters excluded under the applicable warranty, which may include misuse, collision, unauthorized modification, improper assembly, improper maintenance, water damage beyond the product’s stated protection level, incorrect charging practices, normal wear, or use outside the manufacturer’s intended conditions.

Nothing in this section disclaims or restricts any implied warranty or consumer remedy that cannot lawfully be disclaimed or restricted.

10. Product Specifications & Performance Information

Product specifications, including motor power, peak power, top speed, range, torque, battery capacity, charging time, climbing capability, acceleration, payload, and other performance information may be based on information provided by the manufacturer or on testing performed under specified conditions.

Unless expressly identified as an independent Xvelogo test result, performance figures displayed on the Site should not be interpreted as results independently verified by Xvelogo.

Actual performance may vary depending on factors including:

  • Rider weight and payload
  • Riding speed and riding mode
  • Terrain and elevation changes
  • Temperature and weather
  • Battery age, condition, and state of charge
  • Tire type and tire pressure
  • Acceleration and braking behavior
  • Surface conditions
  • Maintenance and mechanical condition

Statements such as “up to,” “maximum,” or similar performance claims refer to results achievable under the applicable manufacturer or stated test conditions and are not a guarantee that every rider will achieve the same result.

11. Product Classification, Street Legality & Local Laws

Important: Certain products sold by Xvelogo are high-powered electric dirt bikes, e-motos, electric motorcycles, or performance electric scooters. They may not qualify as conventional electric bicycles and may not be legal for use on public roads, sidewalks, bike paths, or other public areas in every jurisdiction.

Vehicle classification and legal-use requirements vary by state, county, city, and other local jurisdiction.

Depending on the product and location, applicable rules may include requirements relating to:

  • Registration
  • Driver or motorcycle licensing
  • Insurance
  • Minimum rider age
  • Helmet or protective equipment
  • Lighting, mirrors, signals, or other road equipment
  • Maximum power or speed
  • Use on public roads, trails, parks, or off-highway vehicle areas

Unless we expressly state that a specific product complies with a specific legal classification in your jurisdiction, the availability of a product for sale should not be interpreted as a representation that it may legally be used on public roads or in every riding location.

You are responsible for reviewing and complying with applicable state and local laws before operating a product.

12. Safe Use & Rider Responsibility

Electric motorcycles, electric dirt bikes, and high-performance electric scooters are capable of significant speed and acceleration and may cause serious injury, property damage, or death if used improperly.

You agree to operate products responsibly and in accordance with the manufacturer’s instructions, warnings, manuals, applicable laws, and reasonable safety practices.

Riders should use appropriate protective equipment suitable for the product and riding environment, including a properly fitted helmet and, where appropriate, gloves, eye protection, riding footwear, and protective clothing.

Before riding, you should inspect the vehicle and confirm that critical components such as brakes, tires, wheels, steering, controls, fasteners, and battery connections are properly installed and functioning.

Modifications that increase speed or power, bypass safety systems, alter electrical components, or otherwise change a product from its intended configuration may affect safety, legality, performance, and warranty coverage.

13. Battery & Charging Safety

Products containing lithium-ion batteries must be used, stored, and charged in accordance with the manufacturer’s instructions.

Use only compatible chargers and charging equipment approved or supplied for the relevant product. Do not use a battery or charger that is visibly damaged, excessively hot, swollen, leaking, or otherwise appears unsafe.

Battery damage caused by misuse, incompatible charging equipment, unauthorized modification, improper storage, collision, water exposure beyond the stated protection level, or failure to follow manufacturer instructions may not be covered by warranty.

14. User Accounts

You may create an account to access certain Site features, although an account may not be required for every purchase.

You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account.

You must notify us promptly if you reasonably believe your account has been accessed or used without authorization.

15. Acceptable Use of the Site

You agree not to:

  • Use the Site for unlawful or fraudulent purposes
  • Interfere with or disrupt operation or security of the Site
  • Transmit malicious software, viruses, or harmful code
  • Attempt to gain unauthorized access to Site systems or accounts
  • Scrape or extract Site content in violation of applicable law
  • Impersonate another person or provide intentionally false information
  • Use the Site in a manner that infringes the rights of Xvelogo or others

We may restrict or suspend access to the Site where reasonably necessary to protect the Site, our customers, or our legal rights.

16. Intellectual Property

The Site, including its original text, layout, design, graphics, databases, software, and other Xvelogo-created content, is owned by or licensed to Xvelogo and is protected by applicable intellectual property laws.

Brand names, manufacturer trademarks, product names, logos, images, and other third-party intellectual property remain the property of their respective owners and may be used by Xvelogo in connection with the authorized marketing and sale of their products.

You may not reproduce, republish, distribute, commercially exploit, or create derivative works from protected Site content without the applicable rights holder’s permission, except as permitted by law.

17. Third-Party Services & Links

The Site may contain links to manufacturer websites, payment providers, shipping providers, social platforms, or other third-party websites and services.

We are not responsible for the content, availability, security, or privacy practices of third-party websites that we do not control.

Your use of third-party services may be subject to separate terms and policies imposed by those providers.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Xvelogo and its affiliates, officers, directors, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to the Site or a purchase made through the Site.

To the fullest extent permitted by applicable law, our aggregate liability for a claim directly arising from the purchase of a particular product will not exceed the amount you paid to Xvelogo for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability to the extent arising from fraud, willful misconduct, gross negligence, or any other liability or consumer right that applicable law does not permit us to exclude or limit.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Xvelogo and its affiliates, officers, directors, employees, and agents from third-party claims, liabilities, damages, and reasonable expenses arising directly from:

  • Your unlawful use of the Site or a product
  • Your intentional misuse of a product
  • Your material violation of these Terms
  • Your violation of applicable law
  • Your infringement of a third party’s rights

This section does not require you to indemnify Xvelogo for liability caused by Xvelogo where such indemnification is prohibited by applicable law.

20. Force Majeure

To the extent permitted by law, Xvelogo will not be responsible for a delay or failure to perform an obligation caused by circumstances beyond our reasonable control, including natural disasters, severe weather, war, civil unrest, government actions, labor disruptions, transportation interruption, carrier disruption, supply-chain interruption, power or network failure, or similar events.

This section does not limit any cancellation, refund, or other right that applicable law requires us to provide.

21. Governing Law & Disputes

To the extent permitted by applicable law, these Terms and any sales contract formed through the Site are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law principles.

Before commencing formal legal proceedings, we encourage you to contact us so that we can attempt to resolve the dispute in good faith.

Subject to any mandatory rights or jurisdiction available to you under applicable law, disputes that cannot be resolved informally may be submitted to the competent courts of Hong Kong.

Nothing in this section is intended to deprive a U.S. consumer of any mandatory, non-waivable rights or protections available under applicable federal, state, or local law.

22. Severability, Waiver & Entire Agreement

If any provision of these Terms is determined to be invalid, unenforceable, or unlawful, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

Our failure to enforce a provision of these Terms in one instance does not constitute a waiver of that provision or of our right to enforce it later.

These Terms, together with the policies and terms expressly incorporated by reference, constitute the agreement between you and Xvelogo regarding use of the Site and purchases made through it, subject to any additional product-specific terms disclosed at the time of sale.

23. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our business, products, policies, Site functionality, or applicable legal requirements.

Updated Terms become effective when posted on the Site unless otherwise stated.

Changes will not retroactively alter the contractual terms applicable to an order that was already accepted, except where required by law or expressly agreed with the customer.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms with respect to future use of the Site.
